GTS collects information about you, excluding information that directly identifies you, when you choose to share it with GTS. The sources from which we collect this personal information fall into two categories: information you provide to us and information collected automatically. For example, based on how you interact with GTS and the Services, we may collect information when you track, complete, or upload activities using the Services. GTS also collects information about how you use the Services.
GTS collects and processes location information when you use the Services. We do not track the location of your device when you are not using the Services. In order for most of our core functions (e.g., GPS activity tracking, routes) to work, you must grant us permission in your device's privacy controls to track the location of your device while using the Services.
The GTS Go application collects location data even in the background, that is, when the device has the screen off, but only when an order is in progress, to ensure the correct execution of the work in progress. No location information will ever be collected when there are no trips in progress.
If you wish to stop tracking your device's location, you may do so at any time by changing your device settings.
GTS uses the information collected and received as described below.
We use the information we collect and receive to provide the Services and allow Users, for example, to record your location and analyze your performance, for example to compare past performance and, with your consent, GTS uses the information and provide performance analysis.
GTS uses the information it collects and receives to protect users and to promote security. GTS uses automated tools to help protect and secure you and other users and to keep the Service secure, such as to detect abuse and malicious actors. GTS reserves the right to review users' actions in connection with the Services to ensure compliance with our Terms.
GTS uses the information collected and received to respond to support requests and comments from Users. Depending on your request, you may need to log in to your account, for example, to troubleshoot or replicate a reported issue.
GTS uses the information it collects and receives, including feedback you provide, to conduct research and to analyze, develop, troubleshoot, enhance functionality, and otherwise improve the Services.
GTS does not sell or lease aggregated data to third parties.
GTS anonymizes and aggregates information made available by you or others in connection with the Services ("Aggregated Information"). GTS may use this Aggregated Information for research purposes, such as to improve the performance of its products and Services.
GTS may retain and share your information with third parties, including law enforcement, public or government agencies, or private litigation, inside or outside your country of residence, if we decide that such disclosure is mandatory or reasonably necessary to comply with the law, such as to respond to court orders, subpoenas, or other legal or regulatory process. GTS may also store preserve, or disclose your information, if we believe that such disclosure is reasonably, necessary or appropriate to: (1) prevent death or serious injury to persons, (2) to resolve national security or other issues of public concern, (3) to prevent fraud or abuse of GTS or its users, or (4) protect GTS's business or property or other legal rights, including by disclosure to our legal counsel and other advisors and third parties in connection with actual or potential litigation.
GTS offers several features and settings to help you manage your privacy and share your activities. GTS provides the same suite of privacy controls to all users around the world.
You can correct, change, or update your account or profile information at any time by changing the information in your device's settings. For further assistance, please contact GTS at customercare@gtslogistic.com.
You can delete your data. After you request deletion of your data, we permanently and irreversibly delete personal data from our systems, including backups. After deletion, the User's data. It may take up to 45 days after your account is deleted before all logs and personal data are deleted from our systems. In addition, we may retain information that has been requested to be deleted to comply with the law and take other actions permitted by law.
Our services are not directed or intended for persons under the age of 18. GTS uses technical measures to prevent children under the age of 18 from creating an account. If you are under the age of 18, you should not use the Services.
GTS implements measures to ensure that user information is treated securely and consistently with the terms of this Privacy Policy. We maintain administrative, technical, and physical security measures appropriate to the sensitivity of your information and designed to protect against unauthorized use, disclosure, or access to your information.
You may take additional steps to protect your account and information, such as creating a unique password for GTS that is not easy to guess and is not used elsewhere, not sharing your password with others, and promptly reporting suspicious activity or unauthorized access to your account.
Privacy laws provide certain rights for users in certain jurisdictions. The following are the rights you may have under applicable law.
You have the right to rectify, restrict or delete information, including by requesting us to correct (rectify) it if it is inaccurate, restrict it or delete it on your behalf. Please note that these requests are subject to certain limitations; GTS may retain personal information as permitted by law, such as for tax or record-keeping purposes, to facilitate customer inquiries, and for certain other business purposes described in this Privacy Policy.
For assistance, please contact GTS at customercare@gtslogistic.com. After receiving and validating your User request, we will delete your information, unless exceptions apply.
In certain circumstances you may object to the processing of your information based on our legitimate interests, you may object to the processing in certain circumstances. In such cases, GTS will stop processing your information, unless there are compelling legitimate grounds to continue processing or when it is necessary for legal reasons.
To the extent that we rely on your consent to carry out certain processing (e.g. to process location data), you have the right to withdraw that consent at any time by updating the settings on your device. Please note that past activity will continue to display location data, in accordance with the consent you provided at that time. GTS may continue to process your information if there is a different legal basis for doing so (e.g. to comply with a legal order) or if the withdrawal of consent is limited to certain types of use.
You may raise a concern in relation to GTS's use of your information (and without prejudice to any other rights you may have) by contacting us at customercare@gtslogistic.com. With regard to the right to lodge a complaint, the User may also report his/her concerns to the local data protection supervisory authority.
This section is intended specifically for users who reside in certain jurisdictions outside of the United States ("U.S.), such as residents of the European Economic Area ("EEA"), including the European Union ("EU"), the United Kingdom ("UK"), Switzerland, Brazil, and other relevant jurisdictions around the world (e.g., Latin America, the Middle East, Asia). Please note that as a company based in the European Union, GTS is not necessarily subject to the privacy and data protection laws in your jurisdiction, but is committed to complying with such laws to the extent they are applicable to us.
Residents of certain U.S. states, such as California, Colorado, Connecticut, Oregon, Texas, Utah, Virginia, and Montana, as of October 1, 2024, may have additional rights under the corresponding state laws ("collectively, U.S. Privacy Laws"). Only you or a person legally authorized to act on your behalf may submit a request for your information. Under U.S. privacy laws, you have the right to submit a free request regarding your right to know the information we collect, use, and share twice in a 12-month period. As long as we can validate your request, we will disclose your request no later than 45 days after receipt of your request, unless we request an extension. In the event that we reasonably require a 45-day extension, we will notify you of such extension within the first 45-day period.
You have the right not to receive discriminatory treatment for exercising your privacy rights under state privacy laws, nor will you be discriminated against for exercising any of your rights under U.S. state privacy laws.
We collect the following categories of personal information in connection with the Services. We retain information for as long as we need it to provide the Services, unless we are required by law to retain it for an extended period of time. The information associated with your account will generally be retained for as long as it is needed to provide the Services or until your account is deleted or deactivated. Our decisions take into account the amount, nature, and sensitivity of the information, the purposes for which personal information is processed, whether those purposes can be achieved through other means, and the applicable legal requirements.
In addition, you can delete certain information and remove individual activities from your view on the Services, without having to delete your account. For example, if a User withdraws GTS's consent to process their location information, GTS will delete all location-related information from future uploaded activities.
It may take up to 45 days after the deletion of your account before all records and personal data are completely deleted from our systems. GTS may also retain information to comply with the law, prevent fraud, resolve disputes, troubleshoot problems, assist with investigations, and take other actions permitted by law. The information we hold will be handled in accordance with this Privacy Policy.
GTS reserves the right to change this Privacy Policy at any time. If we make changes to this Privacy Policy, we will post the revised Privacy Policy and its effective date. In the event of changes that we consider substantial, advance notice will be highlighted. If you object to any changes to the Privacy Policy, you must cease using the Services and request deletion of your account at customercare@gtslogistic.com.
